Melo

Terms of Service

By using Melo — the apps or the website at themelo.in, including a Melo player embedded on another site — you agree to these terms. If you do not accept them, please do not use the service. If you are under the age at which you can enter a contract where you live, use Melo only with a parent's or guardian's agreement.

Melo is provided by Sudhi S, an individual developer in Kerala, India ("we"). These terms are written in English; a translation is for convenience and the English text governs.

What Melo is

Melo is a directory and player for internet radio streams that are already publicly broadcast on the open internet. It is provided free of charge, as is, by an individual developer.

Melo is a conduit: it tells your device where a stream is, and your device connects to it. Where a browser cannot make that connection itself — a plain "http://" stream inside an "https://" page — the website passes the stream through our servers unchanged, byte for byte, storing nothing and altering nothing. In either case the audio originates with, and belongs to, the broadcaster.

What Melo is not

We do not own, operate, control, or have any relationship with the stations. Each stream is broadcast by an independent third party. We do not select, record, edit, transcode or archive their audio. Where the website relays a stream, it does so as a mere conduit, in the sense of the EU Digital Services Act and India's Information Technology Act: automatically, without choosing the content, without modifying it and without keeping it.

In particular:

- We do not know what a station is broadcasting. Listings are assembled automatically from public radio directories and from stations' own published information. Nobody listens to a stream before it is listed, and we have no practical means to review continuous live audio from thousands of sources. - We do not verify licensing. Whether a broadcaster holds the music, performance, sports, news or other rights required for what it transmits, and in which territories, is a matter between that broadcaster and the relevant rights holders and collecting societies. We make no enquiry into it and no representation about it. - A listing is not an endorsement, partnership or affiliation, and does not imply a station has authorised its inclusion. - Station names, logos and trademarks belong to their owners and are shown only to identify the station a listing refers to. - Descriptions, artwork, websites and geography come from public directories and from stations' own sites. They may be inaccurate, outdated, or attached to the wrong station.

Streams change constantly. A station may go off air, change address, restrict itself by territory, or begin carrying something entirely different, at any time and without notice to us.

Responsibility for what a station broadcasts

Everything you hear through Melo is broadcast by the station, not by us, and the station alone is responsible for it. That includes the music, speech, news, advertising, religious or political content, and anything else a stream carries; its accuracy, legality, decency and suitability for any listener; the licences and permissions it needs; and any harm that listening to it may cause. We make no representation about any of it, we do not monitor it, and we could not: thousands of stations broadcast continuously.

If something you hear on a station offends you, misleads you or seems unlawful, the party to raise it with is the broadcaster. If you believe the listing itself should not be on Melo, the next section is for you.

The same applies to a Melo player embedded on a third-party website: the site that embeds it is responsible for its own pages, the broadcaster for the audio, and we for the listing only.

Reporting a listing: notice and takedown

If you are a rights holder, a broadcaster, or anyone else who believes a listing should not be there, tell us and we will act. Melo lists where public streams are; it is an information-location tool in the sense of 17 U.S.C. § 512(d) and a search-and-conduit service under the EU Digital Services Act, and this section is our notice-and-action procedure for both.

Email support@sudhi.in with:

- The station name exactly as it appears in the app, and its stream address if you have it; - What is wrong — you own the rights and did not authorise this, the listing points at the wrong station, the content is unlawful, or the broadcaster wants to be removed; - Enough contact detail for us to reply and, for a rights complaint, the basis on which you act.

We aim to acknowledge within 48 hours and to act within 15 days. A station is withheld immediately on request from the broadcaster itself — we do not ask anyone to prove rights in order to remove their own station. Where a listing is lawful in some places and not in others, we may withhold it by territory rather than everywhere.

A listing that is the subject of a well-founded complaint is removed; a broadcaster whose listings are repeatedly the subject of well-founded complaints is not listed again. If you believe a listing was removed in error, write to the same address with your reasons and we will reconsider.

Removing a listing costs us nothing and we would rather do it than argue. Nothing in these terms is meant to discourage a complaint.

If Melo breaks a law where you are: tell us, and we will fix it

Melo is available worldwide and is built by one person. We try to comply with the laws that apply to a radio directory — copyright, broadcasting, privacy, consumer, sanctions and content rules — in every place it is used, but we cannot know every one of them.

If you believe anything about Melo — a listing, a feature, a page, this document — breaches a law in your jurisdiction, write to support@sudhi.in and say which law and what the breach is. We will acknowledge within 48 hours, look into it in good faith, and put it right: by removing or correcting a listing, withholding it in a territory, changing a feature, or amending these documents. Where a court, regulator or other authority directs us, we comply.

That address is our single point of contact for authorities and for users under the EU Digital Services Act, and our grievance officer's contact under India's Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Complaints under those rules are resolved within the time those rules set.

Your licence to use Melo

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the apps and the website for listening to radio. The Melo name, logo, software, design and catalogue are ours or our licensors' and are protected by copyright and trademark law; open-source components in the apps and the website are used under their own licences (the Android app lists them under Settings). Station names, logos and trademarks belong to their owners. Nothing here transfers any of these to you.

Embedding a Melo player on your site

You may embed the Melo player for any station on a website you control, free of charge, using the code on the station's page or the oEmbed endpoint, provided you do not remove or obscure the link back to Melo, do not present the player as your own or as endorsed by the broadcaster, and do not place it on a site that is unlawful or that infringes others' rights. We may change or withdraw the embedded player, or a station in it, at any time.

Your responsibilities

You are responsible for your own use of Melo, including whether listening to a particular station is lawful where you are. Please do not:

- Redistribute, rebroadcast or commercially exploit streams reached through Melo; - Circumvent a broadcaster's territorial or access restrictions; - Overload, scrape or reverse-engineer the service, or access the API by automated means outside normal app use; - Use Melo where its use is prohibited by law, including sanctions and export control law; - Interfere with the service or with other listeners.

We may suspend or block access from a device, address or network that breaks these rules, without notice.

Availability

No uptime is guaranteed. The service, the catalogue, and any individual station may be unavailable or withdrawn at any time, and we may discontinue Melo altogether.

App stores

If you obtained an app from Google Play or the App Store, the store's own terms also apply to your download. Google and Apple are not parties to these terms, have no obligation to provide maintenance or support for the app, and are not responsible for it, for any claim about it, or for any third-party claim that it infringes intellectual property; Apple and its subsidiaries are third-party beneficiaries of these terms as regards the iOS app and may enforce them against you.

Disclaimer and limitation of liability

Melo is provided "as is" and "as available", without warranty of any kind, express or implied, including as to accuracy, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of or inability to use the apps or the website; from the content, conduct, lawfulness or licensing status of any third-party stream, whether your device reached it directly or through our relay; from the accuracy of any station information; from a Melo player embedded on another site; or from any dealing between you and a broadcaster. Because Melo is supplied free of charge, our total liability to you is limited to nil so far as the law allows.

Nothing here excludes liability that cannot lawfully be excluded.

Indemnity

You agree to indemnify us against claims arising from your misuse of the service or your breach of these terms.

Governing law and disputes

These terms are governed by the laws of India. Before starting any proceeding, please write to us and give us 30 days to resolve the matter. The courts at Thiruvananthapuram, Kerala have exclusive jurisdiction over any dispute arising from these terms — without prejudice to any mandatory consumer protection, or right to sue in your own courts, that you enjoy where you live. Consumers in the EU may also use the European Commission's online dispute resolution platform.

Changes

These terms may change. A material change is published here with a new date — which the app and the website show at the top of this document — and takes effect no sooner than 14 days after it is published, except where the law requires an earlier change. Continuing to use Melo after that date means you accept the revised terms; if you do not, stop using Melo.

General

These terms, with the Privacy Policy, are the whole agreement between you and us about Melo. If any part is found unenforceable, the rest stands. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a successor who takes over Melo. Nothing in these terms creates a partnership, agency or employment relationship.
